The H-4 visa is a visa issued by USCIS (U.S. Citizenship and Immigration Service) to immediate family members of the H-1B visa holders.
– The Spouse and Children under age 21 of the H-1B Visa Holder qualify for the H-4 Visa
– USCIS Form I-539 is used for the H-4 visa filing when you are changing status from another non-immigrant status (such as F2, J-2, etc.).
– The current USCIS fee is $370 plus an $85 fee for biometrics per family member applying.
– The H-4 Spouse may apply for permission to work using USCIS Form I-765. The H-4 Children are not eligible to apply for permission to work.
– You need the following documents to apply for the H-4 visa:
From the H-4 Holder:
–Proof of relationship to the H-1B Holder (copy of your Marriage Certificate or Birth Certificate)
–Copy of your unexpired passport picture page
–Copy of your current visa from your passport
–Copy of your most recent I-94
–Proof of current status (if applicable)
From the H-1B Holder Spouse:
–Copy of your unexpired passport picture page
–Copy of your current visa from your passport
–Copy of your most recent I-94
–Copy of your most recent I-797 (if applicable)
–Proof of current status (copies of 3 most recent paychecks)
